Terms of Service

1. Who you are contracting with

longislandstickers.com is operated by On The Island Apparel Inc., trading as Long Island Stickers, at 205 E Main St, Ste 2-1, Huntington, NY 11743. In these terms, "we" and "us" mean that company, and "you" means the person or organization placing the order.

By placing an order you agree to these terms. If you are ordering on behalf of a company, a school, a district or any other organization, you confirm that you are authorized to commit it to these terms.

2. What we sell

Custom die-cut stickers, printed from artwork you supply and cut to the outline of that artwork. Sizes, quantities, materials and options are as presented on the order page at the time you order.

Everything we make is custom. It is manufactured specifically for you, to your specification, and it has no resale value to anybody else. That single fact drives most of section 9.

3. Orders, pricing and payment

3.1 The minimum order

Minimum order: 10 stickers or $10. This is an either/or condition. An order qualifies if it contains at least ten stickers, or if the merchandise value reaches ten dollars, whichever happens first. It is not a price floor: an order that qualifies on quantity is charged its calculated price, however small that price is.

Sales tax and shipping are not counted toward the ten dollar alternative.

3.2 Quantities

Quantities up to 500 pieces can be ordered and priced online. Above 500 pieces, pricing is by written quote through our quote form.

3.3 The price that governs

Prices are calculated by our system from the size, quantity, material and options you select. The price calculated by our server at the time of checkout is the price that applies. If a figure displayed in your browser differs from it for any reason, including a stale page, a caching problem or a manipulated request, the server figure governs.

We may correct a pricing error. If a correction would materially change what you agreed to pay, we will contact you and give you the option to cancel rather than charging you the difference.

3.4 Payment

Orders are paid in full at checkout by card, processed by Square. Production does not begin before payment. Applicable New York sales tax is added at checkout unless a valid exemption has been arranged with us in advance.

4. Your artwork, and your warranty about it

4.1 You keep ownership

You retain all ownership of the artwork you upload. Nothing here transfers your intellectual property to us.

4.2 The license you give us

You grant us a limited, non-exclusive license to store, reproduce, adapt for production, print and cut your artwork solely for the purpose of fulfilling your order and of handling any reprint, reorder, refund or dispute relating to it. That license does not extend to marketing, publication or any other use. If we ever want to show your work as an example, we will ask you first and abide by your answer.

4.3 Your warranty

You warrant that you own the artwork you upload, or that you hold all rights and permissions necessary to have it reproduced. That includes copyright, trademark, rights of publicity and any license terms attached to a font, a stock image or a character.

We do not print other companies' logos, licensed characters, professional or collegiate team marks, or other protected material without evidence of permission. We may decline or cancel any order we believe infringes someone's rights, or that we consider unlawful, hateful or otherwise unsuitable to produce, and we will refund an order cancelled on that basis.

You agree to indemnify us against claims, losses and reasonable costs arising from artwork you supplied that you did not have the right to have reproduced.

5. Artwork review

Basic artwork review is included with every order at no charge. A person examines your file before production.

What review covers: whether the resolution suits the size ordered, whether the background is genuinely transparent, how the cut path will fall around the shape, whether critical content sits too close to the edge, and whether the file opens and processes correctly.

What review is not: it is not proofreading, it is not design, and it is not a redraw. We do not check spelling, dates, phone numbers, web addresses or any other content of your design, and we do not recreate low-resolution artwork as vector art. Responsibility for the content of your design remains entirely yours.

If review identifies a problem, we contact you at the email address on the order and the order waits rather than printing. If we cannot reach you, the order will sit on hold. We are not responsible for delay caused by waiting for a reply from you.

6. Proofs

Some orders receive a proof. Where a proof is issued, production does not begin until you approve it, and the approved proof is the specification the order is produced to.

Please look at a proof properly. Once you approve it, you accept what it shows, and an error visible in an approved proof is not grounds for a free reprint. Requesting a revision restarts the review step.

7. Production

Production time is confirmed after we review your artwork. Unless we have agreed a specific date with you in writing, any timing discussed is an estimate and not a guarantee, and we are not liable for loss caused by a delay.

If you are working to a fixed date, tell us before you order or in the order notes so we can tell you whether it is workable.

8. Pickup and shipping

8.1 Pickup

Pickup is free and takes place at 205 E Main St, Ste 2-1, Huntington, NY 11743. We email you when your order is ready. Please wait for that email. Bring your order number, which begins with LIS. Anyone with the order number may collect the order on your behalf.

We will contact you if an order goes uncollected. We cannot store completed orders indefinitely, and an order that remains uncollected after we have made reasonable attempts to reach you may be disposed of without refund.

8.2 Shipping

Shipping charges are quoted at checkout for the address you supply. You are responsible for the accuracy of that address. A parcel misdelivered because of an incorrect address is not something we can recover for you, and reshipping is at your cost.

Once an order is handed to a carrier, delivery timing is in the carrier's hands. We will help you chase a lost or delayed parcel and will provide tracking, but we are not liable for carrier delay, loss or damage in transit beyond what the carrier recovers.

9. Returns, reprints and refunds on custom goods

Custom stickers are made to your specification and cannot be returned, exchanged or restocked. This includes orders that are no longer wanted, orders placed at the wrong size or quantity, and orders containing a mistake that was present in the artwork you supplied.

If we got it wrong, we will put it right. If your order arrives with a manufacturing defect, or does not match the artwork and specification you ordered or the proof you approved, contact us promptly with your order number and photographs of what you received. Where the fault is ours, we will reprint the affected portion or refund it, at our discretion, and we will tell you straightforwardly which one we are doing and why.

Color variation is not a defect. Printed ink on vinyl and a backlit screen are different things. Reasonable variation between what you saw on a display and what you received, and reasonable variation between separate production runs, is expected and is not grounds for a refund.

Cancellations. Contact us as soon as possible. If your order has not entered production we will do what we can. Once printing has begun, an order cannot be cancelled, because the material has been consumed on a product nobody else can use.

10. Disclaimer of warranties

We warrant that your order will be produced in conformity with the specification you ordered and, where one was issued, with the proof you approved. Beyond that, and to the fullest extent permitted by law, the products are supplied without warranty of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

In particular, we make no representation about how a sticker will perform on any specific surface, in any specific environment, or over any period of time. How a sticker behaves depends on where it is applied, how the surface was prepared, and what happens to it afterwards, and those are outside our control. If a particular performance characteristic matters to your use, ask us before you order and test a small quantity before you commit to a large one.

11. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to an order is limited to the amount you paid for that order.

We are not liable for indirect, incidental, special or consequential loss, including lost profit, lost revenue, lost opportunity, the cost of substitute goods, or loss arising from an event that did not go as planned.

Nothing in these terms excludes any liability that cannot lawfully be excluded.

12. Privacy

How we handle your information, including your artwork, is set out in our privacy policy, which forms part of these terms.

13. Changes to these terms

We may update these terms. The version in force for your order is the version published at the time you placed it. Changes are not applied retroactively to an order already placed.

14. Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict of laws rules.
